1. Agreement to Terms
By accessing or using MavunoSasa's website (mavunosasa.xyz), mobile services (USSD, SMS, WhatsApp), or any of our programs, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
These terms constitute a legally binding agreement between you and MavunoSasa, a social enterprise registered and operating under the laws of the United Republic of Tanzania.
2. Our Services
MavunoSasa provides the following services to registered users:
- Agricultural Input Distribution: Access to quality seeds, fertilizers, and farming tools at subsidized prices through our network
- Training & Capacity Building: Free educational programs on modern farming techniques, climate-smart agriculture, and financial literacy
- Market Linkages: Direct connections to verified buyers for fair pricing, eliminating unnecessary middlemen
- Financial Services: Facilitation of microloans, savings products, and crop insurance through our partner financial institutions
- Advisory Services: SMS and USSD-based crop advisories, weather alerts, and market price updates
Services may vary by region and are subject to availability. MavunoSasa reserves the right to modify, suspend, or discontinue any service with reasonable notice.
3. Registration & Eligibility
3.1 Eligibility
- You must be at least 18 years of age
- You must be a resident of Tanzania or operating a farm within Tanzania
- You must provide accurate and truthful information during registration
3.2 Account Responsibility
- You are responsible for maintaining the accuracy of your registration information
- You must notify us promptly of any changes to your contact details
- You are responsible for all activities conducted under your registered phone number
- Sharing your account credentials with others is prohibited
4. User Obligations
As a MavunoSasa user, you agree to:
- Provide accurate information about your farm, crops, and farming practices
- Use agricultural inputs and training materials as directed for their intended agricultural purpose
- Repay any microloans or credit facilities according to the agreed schedule
- Not resell subsidized inputs for profit at the expense of other farmers
- Participate honestly in surveys, impact assessments, and feedback sessions when requested
- Respect other farmers, agents, and MavunoSasa staff
- Not use our platform for any illegal or fraudulent activities
5. Financial Services Terms
5.1 Microloans
- Loan eligibility is determined by MavunoSasa's risk assessment criteria, including farming history and repayment capacity
- Loan terms, interest rates, and repayment schedules are communicated clearly before disbursement
- Failure to repay loans may result in suspension from MavunoSasa programs and reporting to credit reference bureaus
- All financial services are provided in partnership with licensed financial institutions regulated by the Bank of Tanzania (BOT)
5.2 Crop Insurance
- Insurance products are underwritten by licensed insurance companies
- Coverage terms, premiums, and claim procedures are detailed in separate insurance agreements
- MavunoSasa acts as a facilitator, not as an insurer
6. Field Agent Terms
If you apply and are accepted as a MavunoSasa field agent:
- You act as an independent contractor, not an employee of MavunoSasa
- You must complete all required training before engaging with farmers
- Commission structures and payment terms are outlined in your Agent Agreement
- You must represent MavunoSasa accurately and honestly in all interactions
- Misrepresentation of our services or exploitation of farmers will result in immediate termination
- You must protect the personal data of farmers you interact with
7. Intellectual Property
- The MavunoSasa name, logo, website content, training materials, and software are our intellectual property
- You may not copy, modify, distribute, or create derivative works from our materials without written permission
- Farmers and agents may use our materials solely for their intended purpose within the MavunoSasa program
8. Limitation of Liability
MavunoSasa strives to provide reliable services, but:
- We do not guarantee specific crop yields, market prices, or income levels
- Agricultural outcomes are influenced by weather, pests, market conditions, and other factors beyond our control
- Our advisory services are recommendations, not guarantees — farmers retain full responsibility for their farming decisions
- We are not liable for losses resulting from natural disasters, market fluctuations, or force majeure events
- Our total liability for any claim shall not exceed the fees you have paid to MavunoSasa in the preceding 12 months
9. Termination
- You may discontinue using MavunoSasa services at any time by contacting us
- MavunoSasa may suspend or terminate your access for violation of these terms, fraudulent activity, or non-repayment of financial obligations
- Upon termination, any outstanding financial obligations remain due
- We will retain your data as described in our Privacy Policy
10. Dispute Resolution
In the event of a dispute:
- Negotiation: We encourage direct communication first. Contact us at info@mavunosasa.xyz
- Mediation: If negotiation fails, disputes will be referred to mediation under the Tanzania Arbitration Act
- Arbitration: Unresolved disputes will be settled through binding arbitration in Dar es Salaam, Tanzania
These terms are governed by and construed in accordance with the laws of the United Republic of Tanzania. The courts of Dar es Salaam shall have jurisdiction over any legal proceedings.
11. Governing Law
These Terms of Service are governed by:
- The Law of Contract Act (Cap 345, R.E. 2019) of Tanzania
- The Electronic and Postal Communications Act (EPOCA)
- The Tanzania Data Protection Act (2022)
- The Microfinance Act (2018) — for financial services
- The Fair Competition Act (2003)
- Any other applicable laws of the United Republic of Tanzania
12. Changes to These Terms
MavunoSasa reserves the right to update these Terms of Service at any time. Significant changes will be communicated to registered users via SMS at least 30 days before they take effect. Continued use of our services after changes constitutes acceptance of the updated terms.
